Kenya Embassy Faces ‘Dutch’ Auction in Sh3b Case
Published May 31st, 2006
Kenya Embassy buildings and other Government property in The Netherlands could be auctioned in a Sh3 billion suit filed by a Dutch firm that constructed a secret military command centre in Nairobi.
The United Nations Commission on International Trade Law (Uncitral) in The Hague has granted Nedermar BV Technologies orders to attach any property belonging to the Kenya Government in The Netherlands to recover the money owed to it for construction of the facility code-named the “Nexus” project in Karen, Nairobi.
The commission is part of the Permanent Court of Arbitration in The Hague.
The order to attach the properties was issued three weeks ago in The Netherlands, but was handed to the office of the Head of Civil Service and Secretary to the Cabinet, Mr Francis Muthaura, only on Monday.
A senior Government official confirmed the Government had received the court order but that it was still studying the document before releasing a comprehensive statement.
The Standard also confirmed the information with an independent source in The Netherlands, who said the case was handled by Attorney-General Amos Wako, who contracted a team of French lawyers.
Among the properties to be attached are Ambassador Mrs Karimi Mugambi Mworia’s office and residence.
The Embassy of Kenya in The Netherlands is based in The Hague, along Nieuweparklaan 21 2597 LA.
